1. Overview

This website is operated by Lekker Kitchen Inc. ("Lekker Kitchen", "we", "us" or "our"), founded by Fiona Motala. Throughout the site, "you" means the visitor or customer using it. By visiting our site or purchasing from us, you agree to these Terms of Service, together with our Refund Policy and Privacy Policy. If you do not agree, please do not use the site.

2. Using our online store

By using this site you confirm that you are at least the age of majority in your state or province of residence, or that you have your guardian's permission. You may not use our products for any illegal or unauthorized purpose, and you must not violate any laws in your jurisdiction while using the site. A breach of these Terms may result in immediate termination of your access.

3. Accuracy of information

We try to keep the content on this site accurate, complete and current, but we make no guarantee that it is. Material on the site is provided for general information only and should not be relied on as the sole basis for decisions without checking primary sources such as product labels. We may change site content at any time without notice.

4. Products, food and allergens

Our food is made in a kitchen that handles common allergens, which may include wheat, milk, eggs, soy, tree nuts, peanuts, sesame, fish and shellfish. Please read each product's label and description. If you have an allergy or dietary restriction, it is your responsibility to check ingredients before ordering and before eating. We cannot guarantee that any product is free of trace allergens.

We describe our products, including any halal, seed-oil-free or other claims, as accurately as we can, and we display certifications only where we hold them. Colors and images on the site may vary from the actual product. Products are perishable, so please follow the storage and reheating instructions on the packaging or product page.

We reserve the right, but are not obligated, to limit the sale of products to any person, region or jurisdiction, to limit quantities, and to discontinue any product at any time.

5. Pricing, orders and payment

Prices are shown in US dollars and may change without notice. We reserve the right to refuse or cancel any order, including orders with pricing errors, suspected fraud, or limited stock, and we will refund you in full if we cancel an order you have already paid for. You agree to provide current, complete and accurate purchase and account information, and to update it promptly so we can complete your order and reach you if needed. Taxes, where applicable, are calculated at checkout.

Payments are processed securely by our payment providers through Shopify. We do not store your full card details.

6. Shipping and delivery

All orders are shipped with UPS from Santa Ana, California. Delivery dates shown at checkout or in confirmation emails are estimates, not guarantees, and transit times can be affected by weather, carrier delays and other events outside our control. Because our products are perishable, you are responsible for providing a correct, deliverable address and for receiving and refrigerating or freezing your order promptly. Shipping fees are calculated at checkout. Risk of loss passes to you when UPS delivers the package to the address you gave. For delivery problems, see our Refund Policy.

7. Refunds and returns

Our Refund Policy forms part of these Terms and explains how we handle damaged, incorrect, spoiled and lost orders. Please read it before you buy.

We may give you access to third-party tools and services that we do not monitor or control. You use them at your own risk, as provided "as is" and "as available". Links on our site may lead to third-party websites that we do not own or operate, and we are not responsible for their content, accuracy or practices. Please review their terms before using them.

9. User comments, reviews and submissions

If you send us comments, reviews, ideas or other material, you grant us a non-exclusive, royalty-free right to use, edit, publish and reproduce it in any medium. We may, but have no duty to, remove content that we find unlawful, offensive, defamatory, infringing or otherwise objectionable. You confirm that your submissions do not violate anyone's rights and contain no malicious code.

10. Personal information

Your submission of personal information through the store is governed by our Privacy Policy.

11. Prohibited uses

In addition to other prohibitions in these Terms, you may not use the site or its content to: break any law or regulation; infringe or violate intellectual property rights; harass, abuse, defame or discriminate against anyone; submit false or misleading information; upload viruses or other malicious code; collect personal information about others; scrape or data-mine the site; or interfere with the security or operation of the site. We may terminate your use of the site for violating these prohibitions.

12. Intellectual property

All content on this site, including the Lekker Kitchen name and logo, taglines, photographs, text, recipes, graphics and designs, belongs to Lekker Kitchen Inc. or its licensors and is protected by copyright and trademark law. You may not copy, reproduce, sell or exploit it without our written permission.

13. Disclaimer of warranties and limitation of liability

We do not guarantee that the site will be uninterrupted, timely, secure or error-free. The site and all products are provided "as is" and "as available", without warranties of any kind, express or implied, to the fullest extent permitted by law.

To the fullest extent permitted by law, Lekker Kitchen Inc., its founder, directors, employees and partners will not be liable for any indirect, incidental, special or consequential damages arising from your use of the site or our products. Our total liability for any claim relating to an order will not exceed the amount you paid for that order. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless Lekker Kitchen Inc. and its founder, officers, employees and service providers from any claim or demand, including reasonable attorneys' fees, arising from your breach of these Terms or your violation of any law or third-party right.

15. Severability, termination and entire agreement

If any part of these Terms is found to be unenforceable, that part is limited to the minimum extent necessary and the rest stays in force. These Terms remain effective until terminated by you or by us, and you may stop using the site at any time. Our failure to enforce any right or provision is not a waiver of it. These Terms, our Refund Policy and our Privacy Policy are the entire agreement between you and Lekker Kitchen, and replace any earlier agreements.

16. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Orange County, California, and you consent to their jurisdiction.

17. Changes to these Terms

We may update these Terms at any time. The current version is always on this page, and your continued use of the site after a change means you accept it.
